The Quebec Workplace Health and Safety Act (LSST) imposes a heavy responsibility on various actors in the construction industry. This is particularly true for the project manager on a construction site responsible for overseeing all the work being carried out.

Indeed, the LSST imposes on the principal contractor additional obligations, above and beyond the usual responsibilities of an employer. Among other things, he must give notice of when work at the construction site gets underway, and when it is completed. When circumstances require it, he must also submit a copy of his accident prevention program before construction work gets underway, and must ensure on-site traffic management and appoint a safety officer to be on-site at all times.

Besides the criminal consequences of not complying with the duties assigned to the main contractor, the LSST stipulates that fines may be imposed when violations occur. Moreover, a conviction for an LSST violation may result in the suspension or cancellation of the contractor’s licence.

Consequently, it is important to determine just exactly who, between the client and the contractor, is the project manager on a construction site so that that person can then take the necessary measures to ensure workplace safety on the job site.

Our presentation is intended as a tool to allow a client to identify who is responsible for assuming the role of project manager on any given construction project.
